Q. How do I determine if someone is at fault?

A. For someone to be found at fault for an injury, there must be proof of some sort that there was negligence of some sort on the part of the individual that caused the injury. The injured party must be able to show 1) the existence of some sort of duty owed to you by the person that caused the injury; 2) the failure of the other person to due their duty; 3) that injuries or damages were caused; and 4) that the injuries or damages were caused by the failure of the other person to carry out their duty.
